I. Definitions

• "Customer": refers to the person or people whose body parts are used as the positive form to create a mold, and to the person or persons paying for and approving the piece(s).
• "BNG Life Casting" refers to BNG Life Casting, a sole proprietorship.
• "mold" describes a negative 3-dimensional image of the Customer made by placing in contact with the bod(y/ies) of the Customer materials which copy the form of his/her/their bod(y/ies).
• "cast" describes plaster, cement, or similar material which has been placed while fluid into a mold and allowed to harden to form a copy of the customer's body.
• "piece(s)" refers to the specific casts of the customer as described below:

II. Exchange of Value

BNG Life Casting agrees to provide the piece(s) to the Customer.

The Customer agrees to pay the sum of $________ to BNG Life Casting

The Customer grants to BNG Life Casting the absolute and irrevocable right and permission to use photographs, molds, and casts taken of the Customer. This includes, without limitation, permission for BNG Life Casting to make, alter, divide, and combine copies of the Customer's likeness, to combine the Customer's likeness with those of others, and to retain copyright in, sell, and otherwise make use of the Customer's likeness.

The Customer hereby releases and discharges BNG Life Casting, Mr. Gainer, his heirs, executors, assigns and any designee (including any agency, client, broadcaster, periodical, art dealer or gallery or other distributor of media of any kind) from any and all claims and demands arising out of or in connection with the use of casts, photographs, or works derived from casts or photographs, including but not limited to any claims for defamation or invasion of privacy.

BNG Life Casting agrees to use the contact and shipping information provided below only for its own business purposes. This information will not be provided to any third party.

III. Nature of the Process

The Customer understands that the process of producing a cast is a manual operation, and that individual casts may vary slightly, and have minor imperfections.

The Customer understands that it is possible that creation of a mold can fail, and that a mold can be ruined in the production of casts. In the event that no cast acceptable to the Customer can be produced from a mold, the Customer may elect to either make another attempt at production of a mold, at no additional cost, or to receive a full refund, less the costs of materials consumed.

The Customer understands that the process of making molds involves covering the part(s) of the Customer's body as described by "piece(s)", above, with the materials required to make the mold.

The Customer understands that application of the mold materials will require physical contact by BNG staff with the areas of the Customer's body described by "piece(s)", above.

The Customer understands that making the mold may cause some minimal discomfort or irritation during or after the process of making or removing the mold.
